Win the Must Have Mini – Entry Terms and Conditions

1. The Promoter: Must Have Ideas Ltd (company no. 11293230) whose registered office is at The Ideas Factory, Arc Logistics Park, Holborough Road, Snodland, Kent, ME6 5SZ.

2. The Promotion: The Promoter is offering the chance to win a Mini Cooper SE (Mini) this November 2024, subject in all cases to these terms and conditions.

   The Mini being offered had a market value of approximately £35,000, as of October 2024 and was new to the Promoter at the time of purchase. Although purchased by the Promoter directly from the dealer/ manufacturer, the Mini may have up to 2,000 miles on the clock, which may include delivery mileage and mileage for any promotional photography and videography that the Promoter may require. The Mini will have fair wear and tear for a car of 2,000 miles. The winner will be the second legal owner of the Mini.

   The exact model, specification and colour of the Mini offered to the winner may differ slightly from the model, specification or colour of the Mini shown during the marketing of this Promotion.

   The Mini is wrapped in vinyl wrapping. Because the car is wrapped, additional care is required when maintaining the car for example when washing the car. The winner is free to remove the wrapping at their own cost from the point of collection by the winner.

   It may take up to 28 days from the date the winner is announced to arrange and handover ownership of the Mini.

   The Promoter will make the Mini available for collection at a handing over ceremony in Kent. The winner will be responsible for all their costs in attending the ceremony, including any travel expenses and accommodation costs. Please note the Promoter will not deliver the car directly to the winner and the winner must attend the handing over ceremony in order to collect and take ownership of the car.

   For the avoidance of doubt, there is no cash prize alternative on offer.

3. Eligibility: this Promotion is open to residents of the United Kingdom aged 18 years or over (excluding employees of the Promoter and those employees’ families and those living in the same household as those employees) who make a qualifying purchase on and via the websites (https://musthaveideas.co.uk/) or (https://musthaveideas.tv)
4. By entering this Promotion, an entrant is agreeing to be bound by these terms and conditions.
5. Any additional rules of this Promotion will be displayed on our websites in a prominent position.
6. Entry instructions and conditions: Each qualifying purchase made via one of the above websites will earn an entry or entries into this Promotion. In most cases, each £1 spent on the website by the entrant earns 1 entry and this will be confirmed at the point of purchase. Some items purchased will earn additional entries, where indicated. On certain days during the promotional period, entries may be multiplied, for example double, or tripled, in each case where indicated.
7. No responsibility can be accepted for entries not received for whatever reason or for late entries.
8. No third party or bulk entries are permitted. If it becomes apparent that either an entrant, family or household is using any means to circumvent this condition such as, and without limitation, multiple email accounts, multiple reproduced or computer-generated (including using artificial intelligence) entries, using multiple identities, fraudulently falsifying data, acting fraudulently or dishonestly in the opinion of the Promoter or otherwise acting in violation of these terms and conditions, these entrant(s) will be disqualified, and any prize entitlement will be void.
9. Fees: There is no entry fee to enter this Promotion. In order to enter, all an entrant needs to do is purchase a qualifying product from the website at the listed price.
10. Promotional period: This Promotion will run from Friday 1 November to 21:45 UK time on Friday 29 November 2024. The winner will be picked during our live show on 29 November 2024, which is being streamed on the Promoter’s social media and broadcast live on the Promoter’s TV channel (“Must Have Ideas" available on the Sky, Freesat and YouTube platforms).
11. Winner selection: The winner will be randomly selected by the Promoter.
12. Winner notification: The Promoter will call the winner on the provided phone number live on air. An entrant must be watching the live show between 8pm and 10pm UK time on Friday 29 November 2024 for a chance to win. The winner must answer the phone when we call them live on air between 9:45pm and approximately 10pm UK time on Friday 29 November 2024 and must say the "winning phrase", which the Promoter will announce during the live show. If a winner does not claim their prize by answering their phone within five rings or if the Promoter is directed to voicemail or equivalent or if the Promoter is unable to establish a connection, the Promoter reserves the right to withdraw their prize entitlement and the Promoter will call another winner, and then so forth, by the same method as set out above until a winner is found.
13. It is the responsibility of the entrant to provide correct, up-to-date details when entering the Promotion and acceptance of the prize. This includes providing a contact telephone number at the time of checkout to enable a telephone call to be made on the night of the prize draw. The Promoter shall not be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

Delivery and collection of the Mini is set out above under “The Promotion”.

14. General: The Promoter’s decision is final and binding. No correspondence will be entered into. Entry is deemed acceptance of these terms and conditions.
15. Prizes must be accepted as offered by the named winner. The prizes are not transferable (other than as expressly stated) and cannot be resold until legal ownership has been transferred to the winner.
16. The car will be registered with the Promoter initially. The Promoter will register the winner as the owner of the vehicle on or around the date arranged for collection by the winner. From this point, the winner takes ownership of the car at the ceremony referred to above, the winner will assume sole responsibility for the vehicle, including any liabilities or payments that may arise as result of ownership e.g. speeding fines, road tax, tolls, insurance fees. The Promoter will use reasonable efforts to pass on any manufacturer or dealer warranty(ies) and/or guarantee(s) which will then sit directly between the winning owner and the manufacture or dealer. As between the Promoter and the winner, the car is provided “as is” and “as available”.
17. The Promoter reserves the right to substitute a prize of equal or greater value should circumstances outside its control make this necessary.
18. The Promoter reserves the right to verify winners and ask for proof of identity, age and address and to withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions.
19. You agree that if you are a winner, you will take part in and co-operate fully with reasonable publicity, including appearing in photography and videography, as required by the Promoter, and to the use of your name, location, photograph and any comments in such publicity and marketing materials and on any and all channels without any fee being payable.
20. Provided no objection is received by the winner(s), the name and county of the winners can be obtained by sending an email, 28 days after the Promotion closing date, to [email protected].
21. The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these terms and conditions or the spirit of the Promotion. Those who try to circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.
22. Entry into this Promotion is at the entrant’s sole risk. To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort (including negligence), breach of statutory duty or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting and using a prize. The Promoter further disclaims liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these terms and conditions shall act to limit or exclude the Promoter’ liability resulting from its negligence or fraud.
23. If for any reason, this Promotion is not capable of running as planned for reasons (including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.
24. If an act, omission, event or circumstance occurs which are beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.
25. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to, lost, delayed or not received entries, winner notifications or prizes. The Promoter will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of the Promoter.
26. If any of these terms or conditions should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
27. The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this Promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties. In such case, the Promoter will use reasonable endeavours to avoid consumer disappointment.

29. These terms and conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.
